Peg Arguimbau Chairman, Hank Langstroth, Keevin Geller, and Stephen Cremer, were the members present. Conservation Commission Members, Christine Turnbull and Elizabeth McGrath were absent from the meeting. The Conservation Administrator, Greg Meister, was also present.

7:45 p.m. Fred Bottomley - Cranberry Bogs adjacent to Old Post Road:

Peg explained to the Commission that although she was unable to connect with Mr. Bottomley for an update on the progress of the bog operation, she was informed by him that a double yield of cranberries were recently harvested from the bogs.

7:50 p.m.  Approve Past Meeting Minutes:

Peg called for a motion to approve the October 13, 2011 Meeting Minutes as presented.
Stephen Cremer moved. Hank Langstroth seconded. Voted. 3-0-1. (Keevin Geller abstained.)

8:00 p.m., N.O.I. Pubic Hearing filed by Bay Road Woodland Trust for the  proposed construction of a single-family dwelling with associated utilities and site work at 11 Castle Drive, Subdivision Lot 15 for DEP File # SE-280-0532:

             David Wluka - Realtor

Steven Gioiosa presented a proposed plan to the Commission entitled, “Subsurface Sewage Disposal System Plot Plan,” 10/27/11, last revised date, and the green abutter cards. He explained to the Commission that the proposed project is for the construction of a single-family residence with
associated utilities and grading. This lot is located on the east side of Castle Drive and is part of a subdivision that was approved back in the 1970s (Sharon Highlands). This proposal is a result of a settlement between the Town and Bay Road Woodland Trust. The Commission issued an Order of Conditions for Lot 17 in August 2011. The wetland resource areas of the proposed project site includes a culvert crossing beneath Castle Drive that connects to a wetland system on the west side of Castle Drive with a stream and a wetland system on the east side of the road that eventually flows through the proposed project site. The back portion of the site was previously disturbed when performing some grade work when the subdivision was developed. The proposed location of leaching field for the proposed septic system is in the back portion of the site away from the
100’ Buffer Zone of the proposed project site. There will be no alteration to the wetlands on the site from the proposed project. The Applicant plans to install a siltfence barrier along the limit of work area of the proposed project site.
Mr. Wluka explained to the Commission that when he met last week with the Conservation Administrator, Greg Meister, he agreed to comply with Greg’s request to extend the siltfence barrier along the back portion of the proposed project site.        
The members of the Commission approved the Applicant’s proposed project solely subject to the
M.G.L. Ch. 131 § 40 State of Massachusetts Wetlands Protection Act.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicant per submitted proposed plan with the condition that the Applicant notifies the Conservation Administrator
prior to starting the proposed project for inspection of erosion control measures.

8:15 p.m. N.O.I. Public Hearing filed by Bay Road Woodland Trust for the proposed construction of a single-family dwelling with associated utilities and site work at 9 Castle Drive, Subdivision Lot 16 for DEP File # SE-280-0531:

Steven Gioiosa presented a proposed plan to the Commission entitled “Subsurface Sewage Disposal System Plot Plan, Sheets 1 and 2” 10/28/11, last revised date, and the green abutter cards. He explained
to the Commission that the proposed lot is located on the east side of Castle Drive, south of Lot 15. This lot is part of a subdivision that was approved back in the 1970s (Sharon Highlands). This proposal is a result of a settlement between the Town and Bay Road Woodland Trust. The Applicant is proposing to install a 30” diameter, circular culvert, within the intermittent stream on the site to allow for a graded crossing for the installation and future maintenance of the proposed leaching field. The proposed culvert will be set at the intermittent stream bed and rip-rap will be installed on the downgradient side of the culvert for protection during construction of the proposed project. Approximately 180 s.f. of wetland alteration is being proposed to accommodate the proposed culvert crossing. The proposed wetland replication work is reflected on the Applicant’s proposed plan. Modifications made to the proposed revised plan were previously suggested by the Conservation Administrator. The Applicant accepted those modifications that included the use of retaining walls reducing the limit of work in the back portion of the proposed project site.
The Applicant proposes to install a siltfence staked in place to define the limit of work area shown on the proposed plan.
It was the consensus of the Commission to approve the proposed project with the following conditions:
  • For the Applicant to notify the Conservation Administrator prior to starting the proposed project for inspection of erosion control measures.
  • A wetland scientist hired by the Applicant shall directly supervise the replication work for the proposed project.
  • The Conservation Administrator shall be notified when the proposed replication work is to be
        performed.
  • A 75% survival rate is required of replicated plant species after two growing seasons in the
      proposed replication area.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicant per submitted proposed plan with the conditions as discussed.

8:30 p.m. An Abbreviated N.O.I. Public Hearing filed by Jane Larsson for  the proposed work to enclose an existing wood deck at 175 Mountain Street under DEP File #SE-280-0530:

Jane Larsson appeared before the Commission and submitted a proposed site plan entitled, “Proposed enclosure of deck , 175 Mountain Street, Sharon, MA,” dated September 15, 2011, and the green abutter cards. She explained to the Commission that the proposed project site is comprised of approximately
4.6 acres and abuts Camp Wonderland. The wetland resource areas of the proposed project site surround the perimeter of the existing house. The proposed addition is located approximately 51’ from the delineated wetland line of the proposed project site. The existing wood deck was formerly added to the home many years ago with the intention of enlarging the kitchen area. The proposed project consists of a two-story addition on top of the existing wood deck. The proposed plans include enlarging the existing kitchen and master bedroom area, and the installation of a new master bathroom. The Applicant has hired a structural engineer for the proposed project and he has suggested the construction of a frost wall to the existing side deck as part of the improvements for the proposed project. The Applicant is proposing to upgrade the size of the existing septic system that is located beneath the gravel driveway as part of the proposed project.

The Conservation Administrator, Greg Meister, said that he performed an inspection of the proposed project site and determined that the Applicant’s proposed enclosure of the existing deck with the proposed structural improvements would not be setting a new precedent for this project
The Commission requested the Applicant to submit a copy of a definitive proposed site plan showing the location of the erosion control devices for the proposed project and a copy of the structural engineer’s design plans.
Peg called for a motion to continue the hearing until November 17.

CPC Appointment:

The Commission agreed to postpone their discussion of appointing another member from the Commission to serve as Meredith’s replacement on the CPC until November 17.

Update - Paul Vitali’s Petition Article for the upcoming Fall Town Meeting:

The Conservation Administrator, Greg Meister, explained to the Commission that Paul Vitali recently met with the Selectmen to discuss his petition article for the Fall Town Meeting to transfer the Oakland Road gravel site to the control of the Commission. The Selectmen have agreed with Mr. Vitali’s request to keep the gate on the Oakland Road site locked. The Selectmen are willing to restrict the use of the Oakland Road site that would include limiting the storage of materials on the parcel.
